Medallion Stallion Breeding Agreement
This agreement is by and between the owner of the Stallion listed below and the Minnesota Arabian Horse Breeders, Inc. It is further agreed that for a $500 nomination fee, one breeding is donated to the Minnesota Arabian Horse Breeders, Inc. and said breeding is to be auctioned off pursuant to the rules of the Stallion Service Auction Jackpot Futurity Program. This nomination is contingent on the following conditions:
1) In the event the Breeding does not sell at the Auction, all applicable Stallion Owners will be notified that their donated breeding was a “no sale” in the auction and that they have two options:
a.) They may purchase the breeding themselves for $1,000.00 with a 50% deposit due by November 30th. (They may re-sell the breeding to one of their clients.)
b.) They may withdraw the stallion from the program at no additional expense to them. If withdrawn the stallion is removed from the Medallion Stallion list for the upcoming year, resulting foals are not eligible for MAHB programs. The stallion is dropped from our website and removed from future ads.
2) In the event the stallion owner, by reason of death or injury of the stallion, is unable to fulfill the agreement, the breeding deposit will be refunded without interest, unless frozen semen is available. The stallion may be relocated within the U.S. or Canada before or during the 2015 breeding season. If the stallion is relocated outside the U.S. or Canada and frozen semen is not available, the breeding deposit may be refunded, without interest to the Purchaser upon MAHB, Inc. Board approval.
3) The Stallion Owner has the right to apply their standard charges regarding additional fees for any breeding purchased at the MAHB Fall Festival or to a MAHB nominated Medallion Stallion. These fees may include, but are not limited to: breeding costs of handling, collection, and shipping, transportation, board, fees associated to where a stallion stands, and foaling fees. Since these fees are established by the stallion owner/handler:
a.) MAHB has no responsibility for the determination or payment of these fees;
b.) The fees are subject to change per the stallion owner/handler standard practices;
c.) Any fees are the complete responsibility of the purchaser of the breeding.
Venue for any action respecting this Agreement shall be in Blue Earth County, State of Minnesota, County of Registered Office of Minnesota Arabian Horse Breeders Incorporated.
